Data protection and AI: definition, duties and practice

Definition

Data protection and AI covers how personal data is handled when AI systems are used. It concerns which data an assistant may process, on what legal basis, for how long and who has access. In the EU the GDPR applies. An AI assistant or company brain must honour purpose limitation, data minimisation and data subject rights, otherwise the processing becomes unlawful.

Why the Term Matters

AI is often fed as much data as possible because that improves answers. That collides directly with minimisation and purpose limitation. Who thinks about data protection early clarifies before connecting which sources are really needed, whether a legal basis exists and how data subjects exercise their rights. The assistant stays useful without becoming a legal risk.

When It Is Relevant

  • An assistant processes names, contacts or other personal data.
  • A company brain draws on sources that contain personal data.
  • An external model might process inputs outside the EU.
  • Data subjects want access, deletion or objection.

When Not

If an assistant only processes anonymous or purely technical data with no personal reference, the GDPR duties do not fully apply. And data protection alone does not make a system secure: without clean rights and access control, even lawful processing stays exposed.

Industries That Use It

  • Healthcare: an assistant that strictly separates patient reference and processes only what is needed.
  • Staffing providers: a company brain that uses applicant data only for its purpose.
  • E-commerce: an assistant that uses customer data for support but respects subject rights.
  • Insurers: clear bases and deadlines for processing sensitive details.

Typical Use Cases

  • Check before connecting which sources contain personal data.
  • Mask or remove personal reference where it is not needed.
  • Limit access to sensitive data through roles and rights.
  • Store deletion deadlines and retention in the assistant.
  • Be able to serve access and deletion requests from subjects.

Example

A team wants a company brain over support tickets. Before connecting, customer names and contacts are masked, access to the remaining content is bound to roles and a deletion deadline is set. So the assistant answers questions without needlessly mirroring personal data. This describes the method, not legal advice and not an invented metric.

Service Connection

We build a company brain with access rights and masking and set up a personal AI assistant so it accesses data only for its purpose and with a clear basis.

Sources

This framing describes common practice and is not legal advice. Which GDPR duties apply in concrete terms depends on the data, the purpose and the build, and should be checked against current legal texts and supervisory guidance case by case.

Frequently asked · 03

Frequently asked questions.

May an AI assistant process personal data at all?
Yes, if a legal basis exists and the processing is purpose-bound, minimal and transparent. What matters is using only the data truly needed and preserving data subject rights.
What should I watch with external models?
Where and how inputs are processed. If personal reference leaves the EU, a sound basis is needed. Often masking helps, or a build that does not transfer sensitive data in the first place.
How do I serve deletion requests on a company brain?
By building sources and rights so content can be removed and access withdrawn in a targeted way. That belongs in the build from the start, not only when the first request arrives.
